Conditions d’utilisation et confidentialité

Canna-Coach est prise en charge par le CIUSSS du Centre-sud-de-l’Ile-de-Montréal. Ce projet est le fruit de la collaboration entre différent.e.s chercheur.e.s universitaires (UQAM, Université de Sherbrooke, Université du Québec à Trois-Rivières, Université Laval) et intervenant.e.s de différents milieux de pratique. Canna-Coach a été développée grâce à l’appui financier du ministère de la Santé et des Services sociaux et de Santé Canada dans le cadre des Programmes sur l’usage et les dépendances aux substances (PUDS). Cette application est une adaptation de Stop-Cannabis.ch développée à l’origine par l’Université de Genève. Les vues exprimées ici ne reflètent pas nécessairement celles des partenaires financiers et institutionnels.

Politique de confidentialité : L'application ne collecte pas de données personnelles individuelles, c’est-à-dire que ce que tu inscris dans l’application n’est pas transmis à personne.  Au moment où l'application est désinstallée, tes données sont effacées. Il est possible que tu sois sollicité.e afin de donner ton avis ou que les informations communiquées sur le forum de discussion soient utilisées pour l’amélioration de l’application ou à des fins de recherche par l’équipe Canna-Coach. Si ces invitations sont transmises à des fins de recherche, celles-ci auront été approuvées par un comité d’éthique à la recherche.

Bien que l’information repose sur les meilleures pratiques quant à l’intervention entourant la consommation de cannabis, elle peut ne pas toujours être adaptée à ta situation personnelle. De plus, une prudence est de mise quant aux échanges sur le forum. Il est à noter que l’application ne remplace pas un suivi avec un intervenant si ta consommation présente des risques modérés ou élevés. N'hésite pas à consulter la carte des ressources si tu souhaites entamer un suivi avec un intervenant ou si tu éprouves des difficultés à maintenir tes objectifs. Canna-Coach n’est pas une application pour te procurer du cannabis et n’encourage pas la consommation. Étant donné que Canna-Coach représente un projet pilote, il est possible qu’elle ne soit pas maintenue à travers le temps ou qu’elle soit reprise par un autre organisme.
 

L’application Canna-Coach et le forum canna-coach.ca ont été créés pour les jeunes du Québec âgé.e.s de 14 à 25 ans qui consomment du cannabis. Canna-Coach s’inscrit dans le cadre d’un projet pilote visant à démontrer que l'application et le forum sont adaptés aux jeunes qui consomment du cannabis. Cette application te donne des conseils selon le changement que tu souhaites effectuer. Elle a été développée par des expert.e.s du domaine de la consommation de cannabis en collaboration avec des jeunes concerné.e.s. Étant donné que Canna-Coach représente un projet pilote, il est possible que l’application et le forum ne soient pas maintenus à travers le temps ou qu’ils soient repris par un autre organisme.

L’utilisation de Canna-Coach (l’application et le forum) est sujette à ces conditions d’utilisation, aux règles de la communauté et à la politique de confidentialité. La gestion de Canna-Coach est réalisée par le CIUSSS du Centre-Sud-de-l'Île-de-Montréal (« nous »). En utilisant Canna-Coach et son contenu, tu reconnais être un « utilisateur.trice » et avoir lu et compris ces conditions. Tu peux utiliser l’application sans utiliser le forum et vice versa.

1.     VOTRE DROIT D’UTILISER CANNA-COACH ET SON CONTENU

1.1   Tes droits d’accès et d’utilisation.

Nous mettons à ta disposition Canna-Coach et son contenu pour te permettre :

• De réfléchir et d’apporter des changements si tu le souhaites entourant ta consommation de cannabis;
• De recevoir une rétroaction entourant ta consommation de cannabis et de te fixer un objectif;
• D’obtenir des conseils et encouragements de la part de l’application;
• D’échanger avec d’autres jeunes qui vivent une réalité similaire à la tienne;
• De te donner accès à une liste de ressources.

Ces cinq points constituent l’utilisation permise de Canna-Coach et son contenu (« fins permises »). Aucun compte n’est requis pour accéder ou utiliser l’application et son contenu, mais un compte est requis pour utiliser le forum.

1.2   Tes obligations.

Tes droits d’accès et d’utilisation sont sujets à ce que tu :

• a) utilises Canna-Coach et son contenu uniquement pour les fins permises;
• b) utilises Canna-Coach et son contenu à des fins personnelles (d’information et d’éducation);
• c) n’utilises pas Canna-Coach pour faire la promotion ou vendre du cannabis ou toute autre substance (tabac, alcool, médicament ou autres drogues), que ce soit directement sur le forum ou à l’extérieur de cette plateforme;
• d) accèdes à Canna-Coach et au contenu uniquement par des serveurs habituels en téléchargeant l’application via un magasin d’applications (« e-store »);
• e) n’utilises pas Canna-Coach ou son contenu pour harceler, abuser, surveiller, menacer ou autrement porter atteinte à toute personne; 
• f) ne télécharges pas de virus, de chevaux de Troie ou d’autres codes malicieux;
• g) ne fasses pas les choses suivantes : (i) transférer, créer, vendre, prêter, louer, sous-licencier ou céder les droits qui te sont accordés; (ii) donner des droits sur Canna-Coach et son contenu; (iii) copier, changer, désassembler, décompiler, dériver, modifier ou extraire tout code source; ou (iv) utiliser ou exploiter Canna-Coach et son contenu pour nuire ou alourdir leur capacité.

Sur le forum, tu ne peux pas :

• a) enfreindre la loi en utilisant le forum;
• b) tenter d’utiliser ou utiliser le compte d’une autre personne;
• c) te faire passer pour quelqu’un d’autre sur le forum;
• d) vendre, acheter ou échanger un compte du forum;
• e) diffuser des publicités, des chaines de lettres et toute autre sollicitation sur le forum, ou utiliser le forum afin d’obtenir les informations personnelles d’autres utilisateurs.trices;
• f) automatiser l’accès au forum ou réaliser une surveillance continue du forum à partir notamment de web crawlers (robots d’exploration) de plug-ins (modules d’extension) ou de add-ons (modules complémentaires) de fureteurs ou de tout autre programme qui n’est pas un fureteur Internet;
• g) faussement affirmer que tu es affilié.e ou soutenu.e par l’équipe Canna-Coach;
• h) Présenter une section du forum sur d’autres sites web en utilisant notamment <iframe>;
• i) tenter de contourner ou contourner la sécurité du forum ou de son accès;
• j) accaparer l’infrastructure du forum avec un volume déraisonnable de requêtes;
• k) encourager ou aider quelqu’un à enfreindre les présentes règles;
• l) soumettre du contenu illégal ou qui enfreint la propriété intellectuelle, offensant ou blessant pour les autres. Ce qui inclut le harcèlement, le contenu inapproprié ou abusif. 

2.     AUCUN FRAIS NI PUBLICITÉ

2.1   Canna-Coach et son contenu.

L’utilisation de Canna-Coach et de son contenu te sont offerts sans frais et sans publicité.

2.2   Utilisation de votre appareil.

Les coûts d’utilisation de ton appareil qui te sont chargés par ton fournisseur Internet ou de téléphonie vont s’appliquer selon l’utilisation que tu feras de celui-ci (p.ex. consommation de données).

3.     PROPRIÉTÉ DE CANNA-COACH ET DE SON CONTENU

3.1   Nos droits de propriété.

Tu reconnais et comprends :

• a) que Canna-Coach (incluant ses fonctions et composantes) et son contenu nous appartiennent;
• b) que tu peux référer à Canna-Coach et à son contenu, ou inclure un lien vers les magasins (« e-store ») où Canna-Coach peut être téléchargée, tant que cela est fait pour les fins permises;
• c) que tu vas conserver tout marquage « © » ou autres symboles de droit d’auteur (ou autre droit de propriété intellectuelle) se trouvant sur Canna-Coach ou son contenu;
• d) que tu ne vas pas utiliser nos marques de commerce, logos et autres symboles et noms sans notre permission.

3.2   Communication.

Tu conviens de communiquer avec nous si tu es mis au courant d’une utilisation non autorisée de Canna-Coach ou de son contenu.

4.     RESPONSABILITÉ ET LIMITATION

4.1   Responsabilité.

Tu es   responsable de l’utilisation que tu fais de Canna-Coach ou de son contenu ainsi que de tout dommage causé à ton appareil en lien avec cette utilisation. L’information véhiculée dans l’application Canna-Coach est orientée selon tes réponses. Bien que l’information repose sur les meilleures pratiques quant à l’intervention entourant la consommation de cannabis, elle peut ne pas toujours être adaptée à ta situation personnelle. De plus, une prudence est de mise quant aux échanges sur le forum. N'hésite pas à consulter la carte des ressources dans l’application si tu souhaites entamer un suivi avec un intervenant.e ou si tu éprouves des difficultés à maintenir tes objectifs. Canna-Coach n’est pas une application pour te procurer du cannabis et n’encourage pas la consommation. Toute consommation de cannabis peut comporter des risques à court et à long terme. Les conseils donnés entourant une utilisation à moindre risque ne garantissent donc pas le risque zéro. Les choix et conséquences entourant ta consommation demeurent sous ta responsabilité. Étant donné que Canna-Coach représente un projet pilote, il est possible qu’elle ne soit pas maintenue à travers le temps ou qu’elle soit reprise par un autre organisme.

4.2   Limitation de responsabilité.

Même si nous utilisons des technologies jugées adéquates, Canna-Coach et son contenu – comme toute technologie – n’est pas infaillible ou à l’abri d’évènements imprévisibles. De plus, Canna-Coach et son contenu n’ont pas été créés pour rencontrer les besoins spécifiques de certain.e.s utilisateur.trice.s ou pour fournir une liste de tous les moyens disponibles pour intervenir en situation de consommation de cannabis. Canna-Coach ne remplace pas l’aide, les soins ou l’évaluation qu’un.e professionnel.le peut offrir, ni l’assistance que la police ou d’autres services d’urgence offrent.

Sujet aux lois applicables, nous ne faisons pas de représentation ou garantie en lien avec (a) l’usage et la pertinence pour une fin particulière de Canna-Coach ou de son contenu; (b) leur usage ininterrompu, continu et sans bogue; (c) leur disponibilité en tout temps et sans délai; (d) leur conformité, autres qu’aux critères prévus dans ces conditions d’utilisation; et (e) les droits de propriété intellectuelle en lien avec ceux-ci.

Dans le forum et l’application, nous ne sommes pas responsable des conséquences liées aux situations suivantes : divulgation d’informations personnelles par les utilisateur.trice.s; propos et comportements des autres utilisateur.trice.s; adéquation des réponses des modérateur.trice.s avec tes besoins précis; une situation d’urgence ou nécessitant une intervention immédiate; découverte par un.e membre de ton entourage de ton utilisation de Canna-Coach. 

5.     DURÉE ET FIN

5.1   Début.

Ces conditions d’utilisation s’appliqueront dès que tu auras téléchargé ou consulté Canna-Coach ou son contenu.

5.2   Fin.

Tu peux cesser d’accéder, de consulter et d’utiliser Canna-Coach ou son contenu quand tu veux sans avoir à faire quoi que ce soit. Tu peux aussi supprimer l’application Canna-Coach de ton appareil et supprimer ton profil et tes messages sur le forum.

Nous pouvons aussi mettre fin à Canna-Coach ou à son contenu. Ceci sera fait conformément aux lois applicables.

5.3   Droit de suspension de certains accès

Au lieu de mettre fin à Canna-Coach et à son contenu, nous pouvons limiter, restreindre ou suspendre l’utilisation ou l’accès à Canna-Coach, le temps de régler une situation (p.ex. un défaut, un bogue ou un virus) ou si tu enfreins les règles de la communauté, la politique d’utilisation ou pour toutes autres raisons que nous jugeons valables.

6.     RENSEIGNEMENTS PERSONNELS

L’application t’offre la possibilité de réaliser un bilan de leur consommation. Afin de réaliser ce bilan, tu dois fournir ta date de naissance. Cette information n’est enregistrée nulle part ailleurs que sur ton appareil mobile. 

Le forum t’offre la possibilité d’échanger avec d’autres utilisateurs et d’afficher certaines informations (pseudonyme, pronoms, âge, objectifs entourant la consommation, langue maternelle). Tu peux modifier ces informations à tout moment sur le forum. Ces informations ainsi que le contenu des échanges demeurent publics et accessibles à l’ensemble des autres utilisateur.trice.s du forum. Les messages que tu publies sur le forum demeurent accessibles aux autres même si tu décides d’en cesser l’utilisation, à moins que toi ou un.e modérateur.trice ne supprime manuellement tes messages. Aucune autre information permettant de t’identifier ne devrait être partagée sur le forum, tel qu’énoncé dans les règles de la communauté. Si tu décides de le faire, nous ne pouvons être tenu.e.s responsables de l’utilisation qu’en feraient d’autres personnes. Pour plus d’informations, voir la politique de confidentialité.

7.     HYPERLIENS ET RESSOURCES

Canna-Coach et son contenu incluent des liens et des numéros de téléphone vers d’autres sites et ressources d’aide. Ces coordonnées sont fournies à titre informatif, entre autres pour faciliter ton accès à plus de soutien entourant ta consommation. Toutefois, nous te rappelons :

• que ces ressources ne sont pas contrôlées par nous;
• que nous ne validons pas systématiquement leur contenu ;
• que nous ne pouvons pas garantir leur contenu.

Ces ressources sont sujettes à leurs propres conditions d’utilisation et politiques de confidentialité. Nous n’assumons aucune responsabilité en lien avec celles-ci. La décision de consulter ces ressources te revient.

8.     AUTRES TERMES

8.1   Accord complet.

Ces conditions d’utilisation constituent, avec la politique de confidentialité et les règles de la communauté, l’ensemble des règles applicables à ton utilisation de Canna-Coach et du contenu. À noter que l’ensemble de ces documents se retrouve sur le site web du forum canna-coach.ca. 

8.2   Modifications.

Nous pouvons modifier ces conditions d’utilisation. Ces modifications seront portées à ton attention à l’avance. Nous comprendrons que tu acceptes ces changements si tu accèdes ou continues d’utiliser l’application ou le forum Canna-Coach, ainsi que leur contenu; si tu n’es pas d’accord avec ces modifications, tu dois cesser d’utiliser Canna-Coach.

8.3   Lois applicables et disputes.

Canna-Coach, son contenu et ces conditions d’utilisation sont sujets aux lois en vigueur au Québec à l’exclusion de tout principe pouvant mener à l’application de lois étrangères. Toute dispute sera soumise aux tribunaux de la Province de Québec, qui auront compétence exclusive pour la régler.

8.4   Communications.

Tu peux communiquer avec nous via les coordonnées suivantes :

Nous allons donner suite à toute communication aussi rapidement que possible, et au plus tard dans les délais prévus aux lois applicables.

En cas d’urgence, tu dois communiquer directement avec les services d’urgence (au 911).

Les présentes conditions d’utilisation sont fortement inspirées de la politique d’utilisation de l’application +Fort développée par Isabelle Ouellet-Morin et ses collaborateurs, avec le soutien du Centre de recherche de l’Institut universitaire en santé mentale de Montréal.

Cette politique de confidentialité s’applique à l’application Canna-Coach et au forum canna-coach.ca. Elle décrit, lorsqu’applicable, la collecte et le traitement qui peut être fait des renseignements personnels des utilisateurs.trice.s de ces deux plateformes par le personnel du CIUSSS du Centre-Sud-de-l'Île-de-Montréal (CCSMTL) (« Nous ») dédié à la modération du forum et à la coordination des deux plateformes. À des fins de recherche, ces données peuvent également être partagées à l’équipe de recherche de l’Université du Québec à Montréal qui a développé Canna-coach et qui poursuit son travail d’analyse et de recherche. 

L’application et le forum s’adressent à des personnes âgées de 14 à 25 ans.

En utilisant l’application, le forum et leur contenu, tu reconnais avoir lu et compris cette politique de confidentialité. Tu peux utiliser l’application sans utiliser le forum et vice versa.

Si tu désires restreindre ou refuser l’accès à tes renseignements pour des fins de recherche, tu peux nous contacter à l’adresse info@canna-coach.ca afin de manifester ton désir de ne pas partager les renseignements que tu auras choisi et les personnes à qui tu ne veux pas que ceux-ci soient communiqués.  

1.     COLLECTE ET UTILISATION D’INFORMATIONS PERSONNELLES

Pour le forum, les informations suivantes sont requises à l’inscription : courriel, pronoms, âge, trois premiers caractères du code postal et langue maternelle. Ton adresse IP est colligée à chaque utilisation du forum. Il est possible que tu sois sollicité.e afin de donner ton avis ou que les informations communiquées sur le forum de discussion soient utilisées pour l’amélioration de l’application ou à des fins de recherche par l’équipe Canna-Coach. Pour assurer ton bien-être et ta sécurité, si jamais tu tiens des propos suicidaires ou compromettant ta vie ou celle des autres (peu importe ton âge), ou si les modérateurs jugent qu’il existe un danger pour ta sécurité ou pour ton développement (17 ans et moins), des mesures seront prises pour contacter les autorités compétentes (p.ex. services d’urgence ou direction de la protection de la jeunesse [DPJ]) et certains renseignements dont nous disposons (p.ex. adresse IP) leurs seront communiquées. Les modérateur.trice.s agiront avec bienveillance au meilleur de leurs capacités, mais ne peuvent être tenu.e.s responsables des conséquences liées au dévoilement d’informations avec les autorités compétentes lors de telles situations. 

2.     RENSEIGNEMENTS QUE TU DÉCIDES DE FOURNIR

2.1   Lorsque tu utilises l’application Canna-Coach

L’application offre la possibilité aux utilisateurs.trice.s de réaliser un bilan de leur consommation. Afin de réaliser ce bilan, la personne doit fournir sa date de naissance. Cette information n’est enregistrée nulle part ailleurs que sur ton appareil mobile. 

2.2   Lorsque tu utilises le forum Canna-Coach.ca

Le forum offre la possibilité aux utilisateur.trice.s d’échanger avec d’autres utilisateurs et d’afficher certaines informations (pseudonyme, pronoms, âge, objectifs entourant la consommation, langue maternelle). Ces informations peuvent être modifiées à tout moment dans le forum par l’utilisateur.trice. Ces informations ainsi que le contenu des échanges demeurent publics et accessibles à l’ensemble des autres utilisateur.trice.s du forum. Les messages que tu publies sur le forum demeurent accessibles aux autres membres même si tu décides d’en cesser l’utilisation, à moins que toi ou un.e modérateur.trice ne supprime manuellement tes messages. Aucune autre information permettant de t’identifier ne devrait être partagée sur le forum, tel qu’énoncé dans les règles de la communauté. Si tu décides de le faire, l’équipe Canna-Coach ne peut être tenue responsable de l’utilisation qu’en feraient d’autres personnes.

2.3   Utilisation faite des données

Les données seront utilisées uniquement à des fins d’amélioration de l’application ou du forum, ou à des fins de recherche. Aucune donnée permettant de t’identifier ne sera transmise à des tiers.

L’équipe Canna-Coach s’engage à :

• préserver la confidentialité des données qui ne sont pas accessibles à tous sur le forum (p.ex. trois premiers caractères du code postal);
• les colliger de façon à ce que nous ne puissions pas t’identifier et;
• les utiliser uniquement sous ce format, à des fins de recherche scientifique et d’enseignement (par nos chercheurs responsables et leurs collaborateurs) et à fins de statistiques et de développement de Canna-Coach, et ce, notamment afin de mieux soutenir les jeunes qui consomment du cannabis. 

Aucune de ces utilisations ne sera faite dans le but (ou de manière) à t’identifier.

2.4   Questions et commentaires

Si tu nous contactes, nous aurons alors accès aux informations que tu nous partageras. Nous allons alors recueillir ces informations pour te répondre et, au besoin, réagir à la situation identifiée. 

3.     TECHNOLOGIES

Certaines technologies de l’application et du forum sont liées aux renseignements généraux de ton appareil (p.ex. langue de l’appareil ou du navigateur, fuseau horaire, etc.) afin d’assurer la cohérence et la sécurité de ta session. Ces technologies sont requises pour que l’application et le forum fonctionnent correctement.

L’application et le forum envoient régulièrement des notifications et des courriels pour favoriser ton engagement. Tu peux à tout moment désactiver les notifications dans les paramètres de ton appareil mobile et les courriels dans les paramètres du forum. L’équipe Canna-Coach n’est pas responsable du fait qu’une personne de ton entourage découvre que tu utilises l’application ou le forum. 

4.     MESURES DE SÉCURITÉ

Nous mettons en place les mesures raisonnablement requises pour préserver la sécurité et la confidentialité de tout renseignement personnel. À cet effet, nous conservons ces renseignements que dans un format qui ne nous permet pas de t’identifier. De plus, nos plateformes et serveurs sont hébergés au Canada. Même si nous utilisons des technologies jugées adéquates, Canna-Coach et son contenu – comme toute technologie – n’est pas infaillible ou à l’abri d’évènements imprévisibles. Tu dois être conscient qu’il existe un risque en lien avec l’utilisation de toute technologie. Nous ne pouvons pas garantir que ton accès ou utilisation de Canna-Coach ou de son contenu ne fera pas l’objet d’une interception de données ou autre évènement incontrôlable.

Privacy policy: The application does not collect individual personal data, i.e. what you enter in the application is not shared with anyone. When the app is uninstalled, your data is erased. It is possible that you will be asked to give your opinion or that the information provided on the discussion forum will be used to improve the application or for research purposes by the Canna-Coach team. If these invitations are sent for research purposes, they will have been approved by a research ethics committee.

The Canna-Coach app and the canna-coach.ca forum were created for Quebec youth, ages 14 to 25 who use cannabis. Canna-Coach is part of a pilot project which aims to demonstrate that the application and the forum are suitable for young people who consume cannabis. This application gives you advice depending on the change you want to make. It was developed by experts in the field of cannabis consumption in collaboration with youths with lived experience. Since Canna-Coach represents a pilot project, it is possible that the application and the forum will not be maintained over time or that it will be taken over by another organization.

Use of Canna-Coach (the app and the forum) is subject to these Terms of Service, the Community Rules and the Privacy Policy. Canna-Coach is managed by the CIUSSS du Centre-sud-de-l’Ile-de-Montréal (« us »). By using Canna-Coach and its content, you acknowledge that you are a " user " and that you have read and understood these terms and conditions. You can use the app without using the forum and vice versa.

1.     YOUR RIGHT TO USE CANNA-COACH AND ITS CONTENT

1.1   Your rights of access and use

We provide you with Canna-Coach and its content to allow you to:

• To reflect and make changes if you wish concerning your cannabis consumption;
• Receive feedback about your cannabis consumption and set a goal;
• To obtain advice and encouragement from the application;
• To exchange with other young people who live a reality similar to yours;
• To give you access to a list of resources.

These five points constitute the permitted use of Canna-Coach and its content (“permitted purposes”). An account is not required to access or use the app and its content, but an account is necessary to access the forum.

1.2   Your obligations

Your access and use rights are subject to:

• a) use Canna-Coach and its content for permitted purposes only;
• b) use Canna-Coach and its content for personal purposes (information and education);
• c) do not use Canna-Coach to promote or sell cannabis or any other substance (tobacco, alcohol, medicine or other drugs), whether directly on the forum or outside of this platform;
• d) Only access Canna-Coach and the content through usual servers by downloading the application via an application store (“e-store”);
• e) do not use Canna-Coach or its content to harass, abuse, monitor, threaten or somehow harm an individual;
• f) do not upload viruses, Trojan horses or other malicious codes;
• g) do not: (i) transfer, create, sell, lend, lease, sublicense or assign the rights granted to you; (ii) grant rights to Canna-Coach and its content; (iii) copy, change, disassemble, decompile, derive, modify or extract any source code; or (iv) use or exploit Canna-Coach and its content to harm or impair their capability to function.

On the forum, you cannot:

• a) break the law while using the forum;
• b) attempt to use or use another person’s account;
• c) impersonate someone else on the forum;
• d) sell, buy or trade a forum account;
• e) post advertisements, chain letters and any other solicitation on the forum, or use the forum to obtain personal information from other users;
• f) automate access to the forum or carry out continuous monitoring of the forum, in particular from web crawlers (crawlers), plug-ins (extension modules) or add-ons (complementary modules) from browsers or any other program that is not an Internet browser;
• g) falsely state that you are affiliated with or supported by the Canna-Coach team;
• h) present a section of the forum on other websites particularly using < iframe >;
• i) attempt to circumvent or get around the security of the Forum or its access;
• j) hog forum infrastructure with an unreasonable volume of requests;
• k) encourage or assist anyone to violate these rules;
• l) Submit content that is illegal or infringes intellectual property, offensive or hurtful to others. This includes harassment, inappropriate or abusive content.

2.     NO FEES OR ADVERTISING

2.1   Canna-Coach and its content

The use of Canna-Coach and its content is offered to you free of charge and without advertising.

2.2   Using your device

The costs of using your device that are charged to you by your Internet or telephone provider will apply accordingly, based on how much you use the application (e.g. data consumption).

3.     OWNERSHIP OF CANNA-COACH AND ITS CONTENT

3.1   Our proprietary rights

You recognize and understand:

• a) that Canna-Coach (including its functions and components) and its contents belong to us;
• b) that you may refer to Canna-Coach and its content, or include a link to the stores (« e-store ») where Canna-Coach can be downloaded, as long as this is done for the permitted purposes;
• c) that you will retain any “©” markings or other copyright symbols (or other intellectual property rights) found on Canna-Coach or its content;
• d) that you will not use our trademarks, logos and other symbols and names without our permission.

3.2   Communications

You agree to contact us if you become aware of any unauthorized use of Canna-Coach or its content.

4     LIABILITY AND LIMITATION

4.1   Liability

You are responsible for your use of Canna-Coach or its content and for any damage caused to your device in accordance with such use. The information conveyed in the Canna-Coach application is oriented according to your answers. Although the information is based on the best methods to aid with cannabis consumption, it may not always be suited to your personal needs and situation. In addition, take caution when discussing with peers on the forum. Do not hesitate to consult the resource map in the application if you wish to start a follow-up with a worker or if you are having difficulty maintaining your objectives. Canna-Coach is not an app to get you cannabis and does not encourage consumption. Any use of cannabis can carry short and long-term risks. Therefore, the advice given regarding lower risk use does not guarantee zero risk. The choices and consequences surrounding your consumption remain your responsibility. Since Canna-Coach represents a pilot project, it is possible that it will not be maintained over time or that it will be taken over by another organization.

4.2   Limitation of liability

Even if we use technologies deemed adequate, Canna-Coach and its content – like any technology – is not flawless or immune to unforeseeable circumstances. In addition, Canna-Coach and its content have not been created to meet the specific needs of certain users or to provide a list of all the means available to intervene in the occurrence of a cannabis consumption situation. Canna-Coach does not replace the help, care or assessment that a professional can offer, nor the assistance that the police or other emergency services offer.

Subject to applicable laws, we make no representations or warranties with respect to (a) the use and fitness for a particular purpose of Canna-Coach or its content; (b) their uninterrupted, continuous and bug-free use; (c) their availability at all times and without delay; (d) their compliance, other than with the criteria provided for in these Terms of Use; and (e) intellectual property rights in connection therewith.

In the forum and the application, we are not responsible for the consequences related to the following situations: disclosure of personal information by users; remarks and behavior of other users; adequacy of the responses of the moderators with your specific needs; an emergency situation or one requiring immediate intervention; discovery by a member of your circle of your Canna-Coach use.

5     DURATION AND TERMINATION

5.1   Start

These Terms of Use will apply as soon as you download or view Canna-Coach or its content.

5.2   En

You can stop accessing, viewing and using Canna-Coach or its content whenever you want without having to do anything. You can also remove the Canna-Coach app from your device and delete your profile and forum posts.

We may also terminate Canna-Coach or its content. This will be done in accordance with applicable laws.

5.3   Right to suspend certain accesses

Instead of terminating Canna-Coach and its content, we may limit, restrict or suspend the use of or access to Canna-Coach, while we resolve a situation (e.g. a defect, bug or virus) or if you violate the community rules, the usage policy or for another reason we deem valid.

6.   PERSONAL INFORMATION

The application offers you the possibility of carrying out an assessment of your consumption. In order to complete this assessment, you must provide your date of birth. This information is not saved anywhere other than on your mobile device.

The forum offers you the possibility of exchanging with other users and of posting certain information (pseudonym, pronouns, age, objectives surrounding consumption, language). You can change this information at any point in time on the forum. This information, as well as the content of the exchanges, remain public and accessible to all the other users on the forum. The messages you post on the forum remain accessible to others even if you decide to stop using the forum, unless you or a moderator manually deletes your posts. No other personally identifiable information should be shared on the forum, as stated in the Community Guidelines. If you decide to do so, we cannot be held accountable for the use that others make of it. For more information, see the privacy policy.

7.     LINKS AND RESOURCES

Canna-Coach and its content includes links and phone numbers to other sites and help resources. These contact details are provided for information purposes, among other reasons, to facilitate your access to more support regarding your use. However, we remind you:

• that these resources are not controlled by us;
• that we do not systematically validate their content;
• that we cannot guarantee their content.

These resources are subject to their own terms of use and privacy policies. We assume no liability in connection with these. It is up to you to consult these resources.

8.     OTHER TERMS

8.1   Entire agreement

These Terms of Use, together with the Privacy Policy and Community Rules, constitute the entire rules applicable to your use of Canna-Coach and the Content. Note that all of these documents can be found on the canna-coach.ca forum website.

8.2   Amendments

We may change these terms of use. These changes will be brought to your attention in advance. We will understand that you accept these changes if you access or continue to use the application or the Canna-Coach forum, as well as their content; if you do not agree to these changes, you must stop using Canna-Coach.

8.3   Communication

These terms of use are strongly inspired by the policy for the use of the +Fort application developed by Isabelle Ouellet-Morin and her collaborators, with the support of the Research Center of the University Institute in Mental Health of Montreal.
 

This Privacy Policy applies to Canna-Coach’s app and canna-coach.ca forum.  It describes the collection and processing of personal information of users on both platforms by CIUSSS du Centre-Sud-de-l'Île-de-Montréal’s (CCSMTL) staff (« We ») which moderate and manage Canna-Coach’s app and forum. For research purposes, collected data may also be shared with Université du Québec à Montréal’s research team which created Canna-coach in order to pursue their research and analytical work. 

The application and the forum are designed for people between the ages of 14 and 25.

By using the application, the forum and their content, you acknowledge having read and understood this privacy policy. You can use the app without using the forum and vice versa.

If you wish to restrict or refuse access to your information for research purposes, you can contact us at info@canna-coach.ca. By doing so, you can express your wish to not disclose personal information and you may select with whom you want to share, or do not share your information with.

1.     COLLECTION AND USE OF PERSONAL INFORMATION

While using the application, it does not require any sharing of personal information. The application does not collect individual personal data, i.e. what you enter in the application is not shared with anyone. When the app is uninstalled, your data is erased. It is possible that you will be asked to give your opinion for the improvement of the application or for research purposes by the Canna-Coach team. If these invitations are sent for research purposes, they will be approved by a research ethics committee.

For the forum, the following information is required at registration: email, pronouns, age, first three letters or digits of a postal code and mother tongue. Your IP address is collected each time you use the forum. It is possible that you will be asked to give your opinion or that the information provided on the discussion forum will be used to improve the application or for research purposes by the Canna-Coach team. To ensure your well-being and safety, if you ever make suicidal or life-threatening comments or remarks related to that (regardless of your age), or if the moderators deem that there is a threat towards your safety and your development (17 years old or younger), measures will be taken to contact the authorities (e.g. emergency services or youth protection department [DPJ]) and certain information we have (e.g. IP address ) will be communicated to them. Moderators will act with benevolence to the best of their abilities, but cannot be held responsible for the consequences of withholding information from authorities in such situations.

2.     INFORMATION YOU CHOOSE TO PROVIDE

2.1   When you use the Canna-Coach app

The application offers users the possibility of carrying out an assessment of their consumption. In order to carry out this assessment, the person must provide their date of birth. This information is not saved anywhere other than on your mobile device.

2.2   When you use the Canna-Coach.ca forum

The forum offers users the possibility of speaking to other users and displaying certain information (pseudonym, pronouns, age, consumption objectives, mother tongue). This information can be modified by the user at any time in the forum. This information, as well as the content of the exchanges, remain public and accessible to all of the other users in the forum. The messages you post on the forum remain accessible to other members even if you decide to stop using it, unless you or a moderator manually deletes your posts. No other personally identifiable information should be shared on the forum, as stated in the Community Guidelines. If you decide to do so, the Canna-Coach team cannot be held accountable for the use that other people would make of this information.

2.3   Use of data

The data will only be used for the purpose of improving the application or the forum, or for research purposes. No data allowing you to be identified will be transmitted to third parties.
The Canna-Coach team is committed to:

• preserve the confidentiality of data that is not accessible to everyone on the forum (e.g. first three characters of the postal code);
• collect information in such a way that we cannot identify you and;
• to only use information in this format, for scientific research and teaching purposes (by our responsible researchers and their collaborators) and for the purposes of statistics and development of Canna-Coach, and, in particular in order to better support young people who consume cannabis.

None of these uses will be made for the purpose (or in a manner) of identifying you.

2.4   Questions and comments

If you contact us, we will then have access to the information you share with us. We will then collect this information to respond to you and, if necessary, react to the identified situation.

3.     TECHNOLOGY

Certain technologies in the application and the forum are linked to your general device information (e.g. device or browser language, time zone, etc.) to ensure the consistency and security of your session. These technologies are required, in order for the application and for the forum to function properly.

The app and the forum regularly send notifications and emails to encourage your engagement. You can disable notifications at any time in your mobile device settings and emails in the forum settings. The Canna-Coach team is not responsible if someone around you discovers that you are using the application or the forum.

4.     SECURITY MEASURES

We put in place the measures required to preserve the security and confidentiality of all personal information. On our end, we only keep this information in a format that does not allow us to identify you. In addition, our platforms and servers are hosted in Canada. Even if we use technologies deemed adequate, Canna-Coach and its content – like any technology – is not infallible or immune to unforeseeable events. You must be aware that there is a risk associated with the use of any technology. We cannot guarantee that your access to or use of Canna-Coach or its content will not be subject to a data interception or other uncontrollable event.

7.3   Applicable laws and disputes

Canna-Coach, its content and this privacy policy are subject to the laws in force in Quebec and to the exclusion of any principle that may lead to the application of foreign laws. Any dispute will be submitted to the courts of the Province of Quebec, which will have exclusive jurisdiction to settle it.
